These Terms and Conditions govern your access to and use of the Dress Up mobile application ("App"), operated by The NOVA AI ("NOVA AI," "we," "us," or "our").

Dress Up is an AI powered fashion application that allows users to upload photographs and generate images featuring different clothing, outfits, and fashion styles.

By downloading, accessing, creating an account, purchasing credits or subscriptions, or otherwise using Dress Up, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must not use the App.

1. Eligibility

You must be at least 18 years old to use Dress Up. The App is not directed to children or teenagers.

By using Dress Up, you represent that:

1. You are at least 18 years old.
2. You have the legal capacity to enter into these Terms and Conditions.
3. The information you provide to us is accurate.
4. You will use the App in accordance with applicable laws and these Terms and Conditions.

The App does not currently verify age through an age-check process. If you are under 18, do not create an account or use the App.

2. Your Dress Up Account

Certain features of Dress Up require you to create or access an account.

You are responsible for:

1. Providing accurate account information.
2. Maintaining the security of your account credentials.
3. Keeping your account information up to date.
4. All activity occurring through your account.

You must not:

1. Create an account using someone else's identity.
2. Impersonate another person or organization.
3. Share your account in a manner that circumvents our usage restrictions.
4. Attempt to access another user's account.

3. Using Dress Up

Dress Up provides AI powered tools that allow you to transform photographs and generate fashion related images.

Features may include:

1. Uploading photographs
2. AI clothing transformations
3. Outfit generation
4. Fashion style transformations
5. Saving generated images
6. Viewing previously generated images
7. Purchasing credits or other digital products
8. Subscribing to paid plans

We may add, modify, suspend, or remove features from the App at any time.

Some features may require credits, a subscription, payment, or other applicable conditions.

4. AI Generated Content

Dress Up uses artificial intelligence to generate and transform images.

You acknowledge that AI generated content:

1. May not always be accurate.
2. May contain visual errors or unexpected results.
3. May not perfectly reproduce a requested outfit.
4. May alter aspects of an uploaded photograph.
5. May occasionally produce results that differ from your instructions.

AI results are provided for creative and informational purposes.

We do not guarantee that any AI generated image will be accurate, realistic, suitable for a particular purpose, or identical to your requested result.

You are responsible for reviewing generated content before using, publishing, sharing, or relying on it.

5. Photos and Content You Upload

You retain ownership of photographs and other content that you upload to Dress Up, subject to the rights necessary for us to operate the App.

By uploading content, you represent and warrant that:

1. You own the content or have permission to use it.
2. You have the necessary rights to allow us to process it.
3. Your upload does not violate another person's rights.
4. Your upload does not violate applicable laws.
5. You are not using the App to infringe copyrights, trademarks, privacy rights, publicity rights, or other rights.

You must not upload photographs of another person without appropriate permission where such permission is legally required.

6. License to Process Uploaded Content

You grant NOVA AI a limited, non exclusive, worldwide, royalty free license to process, reproduce, transmit, temporarily store, and technically modify content you submit solely as necessary to operate, provide, maintain, secure, and improve the features of Dress Up.

This may include transmitting your submitted photograph to service providers that process images on our behalf.

This license does not transfer ownership of your original photographs to NOVA AI.

We do not claim ownership of your original photographs merely because you use them with Dress Up.

7. Generated Images

Subject to these Terms and Conditions and applicable law, you may use images generated through Dress Up for your personal or lawful purposes.

However, AI generated content may not qualify for copyright or other intellectual property protection in every jurisdiction.

NOVA AI does not guarantee that you will obtain copyright or other intellectual property rights in an AI generated image.

You are responsible for determining whether your intended use of generated content is lawful.

You must not use generated content to violate another person's rights or applicable law.

8. Prohibited Uses

You agree not to use Dress Up to:

1. Violate any applicable law or regulation.
2. Infringe another person's copyright, trademark, privacy, publicity, or other rights.
3. Upload photographs without appropriate authorization.
4. Impersonate another person.
5. Create deceptive or fraudulent content.
6. Harass, threaten, defame, or abuse another person.
7. Create or distribute sexually explicit content involving minors.
8. Create exploitative or abusive sexual content.
9. Use virtual try-on to depict nudity, sexual content, or to remove or simulate removing a person's clothing.
10. Create content intended to facilitate criminal activity.
11. Circumvent App security or usage restrictions.
12. Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the App except where permitted by law.
13. Interfere with the operation or security of the App.
14. Use automated systems to abuse, scrape, overload, or attack the App.
15. Attempt to gain unauthorized access to our systems or another user's account.
16. Circumvent subscription, credit, payment, or usage restrictions.
17. Use the App to distribute malware or other harmful software.
18. Use the App in a manner that could damage NOVA AI, its users, or third party service providers.

We reserve the right to restrict or terminate access where we reasonably believe that these Terms and Conditions or applicable law have been violated.

9. Sensitive and Personal Images

You should carefully consider the photographs you submit to Dress Up.

Do not upload photographs containing information that you do not want processed to provide the requested image generation feature.

You should avoid uploading:

1. Government identification documents
2. Financial documents
3. Passwords or authentication information
4. Confidential business documents
5. Highly sensitive personal information
6. Images of other people without appropriate permission

You are responsible for determining whether an image is appropriate to submit to the App.

10. Image Processing and Storage

Original photographs and generated results are stored with your account to provide the service and let you view your creations. They are ordinarily deleted when you delete your account, subject to limited retention for recovery, purchase records, safety reports, legal compliance and security. Photos may be shared with service providers for image processing when needed to complete a request. See our Privacy Policy for details.

AI generated images may be stored in your account so you can view your previous creations.

11. Third Party Services

Dress Up may rely on service providers to provide certain functionality.

These may include providers supporting:

1. Image processing
2. Hosting and storage
3. Account access
4. Error diagnosis
5. Advertising
6. Payment processing
7. Subscription management
8. Security
9. Customer support

Your use of certain features may therefore involve the processing of information by third party providers.

We may change our third party service providers from time to time.

Third party services may have their own terms and privacy policies.

12. Advertising

Dress Up may display advertisements from third party advertising providers.

Advertisements may be personalized depending on your location, device, privacy settings, and applicable laws.

NOVA AI does not control the content of every advertisement displayed by third party advertising providers.

We are not responsible for products, services, claims, or content presented through third party advertisements.

13. Subscriptions

Dress Up may offer recurring subscription plans.

Before completing a subscription purchase, the applicable price, billing period, and other material terms will be presented to you.

Unless otherwise stated in the applicable offer:

1. Subscriptions automatically renew at the end of each billing period, if the purchase terms provide for renewal.
2. Your payment method may be charged for the renewal.
3. You can cancel future renewals through the purchase service used for your subscription.
4. Cancelling a subscription generally does not automatically provide a refund for a previously completed billing period.

The terms of the purchase service used for your transaction may also apply.

14. One Time Purchases and Credits

Dress Up may offer one time purchases such as credits, image generation credits, or other digital products.

Credits and digital products:

1. Have no cash value unless required by applicable law.
2. Are not transferable unless expressly permitted.
3. Cannot be exchanged for cash.
4. May only be used within applicable Dress Up features.
5. May be subject to limits or expiration terms presented at the time of purchase.

Credits may be consumed when an AI generation request is submitted or processed, depending on the applicable feature.

Because AI generation involves third party processing costs and computational resources, a failed or unsatisfactory generation may not necessarily result in an automatic credit refund.

However, we may provide refunds or replacement credits at our discretion or where required by applicable law.

15. Payments and Refunds

Payments are processed by the payment service presented to you when you complete a transaction.

NOVA AI generally does not receive or store your complete payment card information.

Refund requests may be subject to the terms of the purchase service through which the transaction was made.

Where required by applicable law, you retain any mandatory refund or consumer rights.

You may need to submit a refund request through the purchase service used for the transaction.

16. Pricing and Features

We may change:

1. Subscription prices
2. Credit prices
3. Available plans
4. Generation limits
5. Features
6. Promotional offers
7. Usage limits

Changes to recurring subscription pricing will be handled in accordance with the purchase terms and applicable law.

Previously purchased credits or products will not be retroactively changed except where reasonably necessary to comply with law, prevent fraud or abuse, address technical issues, or protect the security and integrity of the App.

17. Intellectual Property

The Dress Up App, including its:

1. Software
2. Design
3. User interface
4. Branding
5. Logos
6. Graphics
7. Text
8. Features
9. Technology
10. Original content

is owned by or licensed to The NOVA AI and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms and Conditions, you may not:

1. Copy the App.
2. Modify the App.
3. Reproduce the App's proprietary content.
4. Sell or redistribute the App.
5. Reverse engineer the App.
6. Extract proprietary materials.
7. Use our trademarks or branding without permission.

Nothing in these Terms and Conditions grants you ownership of NOVA AI's intellectual property.

18. Feedback

If you provide suggestions, ideas, feedback, reviews, or recommendations regarding Dress Up, you grant NOVA AI the right to use that feedback without compensation or restriction.

We may use feedback to develop, improve, and market our products and services.

You retain ownership of any underlying intellectual property in your feedback, subject to the license granted above.

19. Service Availability

We aim to keep Dress Up available and reliable, but we do not guarantee that the App will:

1. Always be available.
2. Be uninterrupted.
3. Be error free.
4. Be free from bugs.
5. Produce identical results for repeated requests.
6. Always process generations successfully.
7. Remain compatible with every device or operating system version.

The App may occasionally be unavailable because of:

1. Maintenance
2. Updates
3. Technical problems
4. Third party service outages
5. Network problems
6. Security incidents
7. Circumstances beyond our reasonable control

20. Account Suspension and Termination

We may suspend or terminate your access to Dress Up if we reasonably believe that you:

1. Violate these Terms and Conditions.
2. Violate applicable law.
3. Abuse the App.
4. Engage in fraudulent activity.
5. Attempt to circumvent payment or credit restrictions.
6. Compromise App security.
7. Harm other users.
8. Abuse third party services.
9. Use the App for prohibited purposes.

We may also discontinue Dress Up or certain features at any time.

If your account is terminated because you violated these Terms and Conditions, you may lose access to your account and stored generated images.

Where required by law, we will provide any applicable rights or remedies.

21. Account Deletion

You may request deletion of your Dress Up account.

Account deletion requests can be submitted to:

Where the App provides an account deletion feature, you may also use that feature.

Upon account deletion, your account information and associated generated images may be deleted, subject to information that we are legally required or legitimately permitted to retain.

Deletion from backup systems may take additional time.

22. Privacy

Your use of Dress Up is also governed by our Privacy Policy, which explains how we collect, process, use, store, and protect your information.

The Privacy Policy forms part of these Terms and Conditions.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Dress Up is provided "as is" and "as available."

We make no warranties, express or implied, regarding:

1. The availability of the App.
2. The accuracy of AI generated results.
3. The reliability of generated images.
4. The suitability of generated content for a particular purpose.
5. The uninterrupted operation of the App.
6. The absence of errors.
7. The availability of particular features.
8. The accuracy of fashion recommendations or transformations.

You use AI generated content at your own discretion and risk.

24. Limitation of Liability

To the maximum extent permitted by applicable law, The NOVA AI and its directors, employees, contractors, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Dress Up.

This may include damages arising from:

1. Loss of data
2. Loss of profits
3. Loss of business
4. Loss of opportunities
5. Inability to use the App
6. Reliance on AI generated content
7. Use or misuse of generated images
8. Third party service interruptions

Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.

25. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless The NOVA AI and its directors, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, and expenses arising from:

1. Your violation of these Terms and Conditions.
2. Your misuse of Dress Up.
3. Content you upload.
4. Content you generate or distribute using the App.
5. Your violation of another person's rights.
6. Your violation of applicable laws.
7. Your unauthorized use of the App.

26. Additional Service Terms

Some features may be subject to additional terms presented when you access or purchase them. Those terms apply alongside these Terms and Conditions.

27. Changes to These Terms and Conditions

We may update these Terms and Conditions from time to time.

The date at the top of these Terms and Conditions indicates when they were prepared or most recently revised.

For material changes, we may provide additional notice through the App or another appropriate method.

Your continued use of Dress Up after updated Terms and Conditions become effective means that you accept the revised Terms and Conditions.

If you do not agree with the updated Terms and Conditions, you must stop using the App.

28. Governing Law and Disputes

These Terms and Conditions shall be governed by and interpreted in accordance with the laws applicable to The NOVA AI, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms and Conditions or Dress Up shall be subject to the jurisdiction of the courts having appropriate jurisdiction over The NOVA AI, except where applicable consumer protection laws provide otherwise.

Nothing in this section limits any mandatory rights or remedies available to consumers under applicable law.

29. Severability

If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue to remain in effect to the maximum extent permitted by law.

30. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Refund Policy and any additional terms presented within the App, constitute the agreement between you and The NOVA AI regarding your use of Dress Up.

They replace any prior agreements or understandings concerning your use of the App, except where expressly stated otherwise.
